Terms and Conditions

Please read these Terms and Conditions carefully before using Alfred.

By accessing or using Alfred, creating an account, using Guest mode, starting a free trial, purchasing a subscription, or otherwise using our services, you agree to be bound by these Terms.

If you do not agree to these Terms, you must not use Alfred.

1. Who we are

Alfred is operated by Learn-Nova (Pty) Ltd, a company registered in South Africa.

Alfred provides AI-powered educational and learning tools through alfred-x.xyz, app.alfred-x.xyz, and other Alfred services or applications we may make available.

References in these Terms to Alfred, we, us, or our mean Learn-Nova (Pty) Ltd.

2. Definitions

  • Account means a registered Alfred user account.
  • Guest means a person using Alfred through Guest mode without a registered Alfred account.
  • Guest mode means limited access to Alfred made available through an anonymous or temporary session.
  • Platform means the Alfred website, web application, AI tutor, and related features and services.
  • Services means the features, functionality, tools, and services made available through Alfred.
  • User, you, or your means any person who accesses or uses Alfred.
  • User Content means files, documents, text, prompts, notes, images, screenshots, audio, video, learning materials, feedback, or other content that you provide to Alfred.
  • Generated Content means content produced through Alfred, including AI responses, summaries, explanations, quizzes, flashcards, feedback, study material, and other generated outputs.
  • Subscription means a paid Alfred plan.
  • Free Trial means the limited trial period Alfred may make available to eligible registered users.

3. Agreement to these Terms

These Terms apply to Guests, registered users, trial users, subscribers, students, educators, and other users of Alfred.

These Terms should be read together with our Privacy Policy, available at alfred-x.xyz/privacy. Our Privacy Policy explains how Alfred collects, uses, stores, shares, and protects personal information.

If you use Alfred on behalf of a school, business, institution, or other organisation, you confirm that you have authority to act on its behalf where required.

4. Eligibility

Minimum age

You must be at least 12 years old to use Alfred.

If the laws applicable to you require the consent or authorisation of a parent, legal guardian, or other authorised adult before you may use Alfred or allow us to process your personal information, you may use Alfred only after that required consent or authorisation has been obtained.

By continuing to use Alfred where such consent is required, you represent that the required consent or authorisation has been provided.

Different countries and regions may impose higher age thresholds or additional legal requirements.

Where applicable law prevents us from providing the Services to you without additional requirements being satisfied, we may restrict or discontinue access.

Accurate information

When creating or maintaining an Account, you agree to provide information that is accurate and not deliberately misleading.

  • You must not impersonate another person.
  • You must not create an Account using another person's identity without authority.
  • You must not deliberately provide false eligibility information.
  • You must not misrepresent information in order to receive a benefit, trial, discount, or access level to which you are not entitled.

5. Guest mode

Alfred may allow people to use limited parts of the Platform through Guest mode.

Guest mode may use an anonymous authentication session or identifier.

Guest mode is not a registered Account, may contain limited functionality, may have separate usage limits, and may not preserve all information indefinitely.

Using Guest mode does not automatically start your 7-day Free Trial.

Alfred may change Guest-mode limits or features from time to time.

Creating a registered Account may provide access to functionality that is unavailable to Guests.

Guest-mode activity remains subject to these Terms.

6. Accounts and account security

To access certain Alfred features, you may need to create an Account.

You are responsible for maintaining the confidentiality of your login credentials, using a secure password, keeping your Account information reasonably current, and activity carried out through your Account where that activity results from your actions or failure to reasonably protect your credentials.

You must notify Alfred if you reasonably believe your Account has been compromised.

You may not sell, transfer, rent, or provide another person with control of your Account unless Alfred expressly permits it.

7. Free Trial

Trial duration

Eligible users may receive a 7-day Free Trial.

Starting or using Guest mode does not start the Free Trial.

The Free Trial begins only when the applicable trial activation conditions are satisfied.

Trial eligibility

The Free Trial is intended to allow an eligible user to evaluate Alfred before purchasing a paid Subscription.

Unless Alfred expressly provides otherwise, a person is generally entitled to only one Free Trial.

You must not attempt to obtain repeated trials through multiple Accounts, alternative email addresses, false identities, manipulated devices, network changes, account sharing, technical circumvention, or other methods intended to evade trial restrictions.

Trial-abuse detection

Alfred may use account, identity, device, browser, network, usage, and security information to detect suspected trial abuse.

This may include device identifiers, device or browser fingerprints, IP and network information, Account identifiers, authentication information, previous trial activity, and relevant usage patterns.

A shared network or IP address alone will not necessarily be treated as proof of abuse.

Where our systems identify activity that may represent abuse, the case may be flagged for review.

Alfred may approve the trial, deny or withdraw trial eligibility, request additional information, restrict the Account, or take other reasonable action.

Users may appeal an abuse-related decision. Information about this processing is available in our Privacy Policy.

8. Plans, limits, and feature availability

Alfred may offer Guest, trial, paid, promotional, or other plans.

Each plan may have limits relating to AI messages, uploads, quizzes, flashcards, audio or video processing, Cards, Sessions, storage, feature availability, and other usage.

The current features and limits of a plan are described on the Alfred pricing page or within the Platform.

You may not intentionally circumvent plan or usage restrictions.

Alfred may update plan structures, limits, and features over time.

Where a material change affects a paid Subscription, we will provide notice where reasonably appropriate or required by applicable law.

9. Paid subscriptions

Subscription purchases

Where paid Subscriptions are available, the price, billing period, included features, and applicable terms will be presented before purchase.

By purchasing a Subscription, you authorise the applicable third-party payment processor to process payment using the payment method you provide.

Recurring subscriptions

Where a Subscription is described as recurring, it may automatically renew at the end of each billing period until cancelled.

The renewal terms will be displayed before purchase.

You are responsible for cancelling a recurring Subscription if you do not want it to renew.

Payment processing

Payments may be handled by a third-party payment provider.

Alfred generally does not need to store your complete payment-card number or card security code.

Your payment provider may process information under its own terms and privacy practices.

Cancellation

You may cancel a recurring Subscription using the cancellation method made available through Alfred.

Unless otherwise stated at purchase or required by applicable law, cancellation normally takes effect at the end of the billing period already paid for.

You may continue using the applicable paid features until that period ends.

14-day refund policy

Subject to any additional or mandatory rights available to you under applicable law, Alfred offers a 14-calendar-day refund period for the first payment of a new paid Subscription.

To qualify under this policy, your refund request must be received within 14 calendar days after the relevant first payment was successfully processed.

Where approved, the refund will ordinarily cover the amount paid for that initial Subscription payment.

This voluntary 14-day refund policy does not automatically apply to later recurring renewal payments, repeat purchases of a Subscription previously purchased or refunded, additional products or services purchased separately, upgrades or add-ons, or transactions that have already been refunded, reversed, or successfully disputed, unless Alfred expressly agrees otherwise or applicable law requires a refund.

Unresolved billing or account matters

Alfred may temporarily place a refund request under review where there is a genuine unresolved matter affecting the transaction or Account.

This may include a duplicate or inconsistent transaction, a pending chargeback or payment dispute, a payment reversal, suspected payment fraud, suspected Free Trial or Subscription abuse, an identity or payment-ownership discrepancy, materially inconsistent billing information, an unresolved Account-security issue, or another material irregularity reasonably requiring investigation.

If a refund request was submitted within the 14-day period, placing that request under review does not cause the user to lose the benefit of the original submission date merely because the investigation continues beyond the 14-day period.

Once the relevant matter has been resolved, Alfred will determine the refund request based on the circumstances and the date on which the request was originally submitted.

Alfred may decline a refund available solely under this voluntary policy where, following reasonable review, we determine that the request is connected to fraud, deliberate abuse of the Platform, misuse of payment or chargeback systems, or another material breach of these Terms.

Nothing in this section limits or removes a refund, cancellation, withdrawal, cooling-off, or other consumer right that cannot legally be excluded under the laws applicable to you.

Where a refund is approved, it will generally be returned through the original payment method where reasonably practicable. The time taken for funds to appear after a refund has been issued may depend on the payment provider, bank, card issuer, or other financial institution involved.

Price changes

Alfred may change Subscription prices.

Where a price change affects an existing recurring Subscription, we will provide reasonable notice before the new price takes effect where appropriate or required by law.

You may cancel the Subscription before the new price applies.

10. Your User Content

You retain ownership

You retain whatever ownership rights you lawfully hold in User Content that you provide to Alfred.

Uploading material does not, by itself, transfer ownership of that original material to Alfred.

Licence to operate Alfred

By providing User Content to Alfred, you grant Alfred a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, process, analyse, extract, transform, display, transmit, create technical or educational derivatives from, and otherwise use your User Content as reasonably necessary to provide, operate, secure, maintain, and improve Alfred.

This includes using User Content to provide AI tutoring, summaries, quizzes, flashcards, concept extraction, embeddings, search and retrieval, mastery features, grading, and other Alfred functionality.

11. Using User Content to improve Alfred

You also grant Alfred a non-exclusive, worldwide, royalty-free licence to use User Content, interactions, and related information to develop, evaluate, train, test, and improve Alfred.

This may include use of uploaded or pasted learning materials, prompts, conversations, Generated Content, quiz questions and responses, grading information, flashcard interactions, learning patterns, feedback, screenshots submitted through feedback, and other interactions with the Platform.

These uses may include evaluating AI quality, improving prompts and workflows, developing new educational functionality, training or fine-tuning Alfred systems, improving retrieval and grounding, improving safety, improving abuse prevention, analysing recurring errors, and improving the overall performance of Alfred.

Where reasonably practical, Alfred may minimise, aggregate, pseudonymise, or de-identify information used for these purposes.

Our Privacy Policy contains further information about how personal information is handled.

Effect of deletion on improvements

Deleting your Account does not require Alfred to reverse technical improvements that were already produced through legitimate use of information before deletion.

For example, deletion does not necessarily require us to retrain a model, reverse model-weight changes, remove aggregated statistics, remove properly de-identified data, undo improvements to prompts or systems, or reverse conclusions that no longer identify you.

However, the underlying personal information and User Content associated with your Account will be handled according to the deletion and retention provisions in our Privacy Policy.

12. Your responsibility for User Content

You are responsible for the User Content you provide.

You must have the legal right or permission necessary to provide and process that content through Alfred.

You must not knowingly upload or provide content that unlawfully infringes another person's intellectual-property rights, contains personal information you are not authorised to provide, is unlawful, is malicious or designed to compromise Alfred, or otherwise violates these Terms.

You remain responsible for determining whether you are permitted to upload copyrighted textbooks, lecture material, school material, recordings, or other third-party content.

13. Generated Content

Alfred produces AI-generated educational content. Generated Content may include explanations, summaries, quizzes, flashcards, feedback, grading, study material, and AI tutor responses.

To the extent Alfred owns or controls rights in Generated Content, Alfred grants you a non-exclusive licence to use that Generated Content for lawful personal and educational purposes.

Because Generated Content may be created using artificial intelligence, it may not qualify for intellectual-property protection in every jurisdiction, and similar or identical outputs may be generated for other users.

Alfred does not guarantee that Generated Content is unique.

You may not claim ownership of Alfred's underlying software, models, prompts, systems, branding, interfaces, or proprietary technology merely because those systems generated content for you.

14. AI-generated information

AI systems can make mistakes.

Alfred does not guarantee that Generated Content will always be accurate, complete, current, consistent, or suitable for a particular assessment or educational purpose.

You should verify important academic information against appropriate sources, including official learning materials, textbooks, educators, or other authoritative sources.

Alfred is a learning-support tool. It is not a replacement for a qualified teacher, examiner, academic institution, or other relevant professional.

15. No guarantee of academic results

Alfred does not guarantee particular grades, examination results, admission to an institution, completion of a qualification, improved academic performance, or any specific educational outcome.

Learning outcomes depend on factors beyond Alfred's control.

16. Academic integrity

Alfred is intended to support learning, not academic dishonesty.

You are responsible for complying with the rules of your school, university, college, examination authority, educator, or other institution.

You must not use Alfred to cheat or engage in prohibited academic conduct.

Submitting Generated Content as your own work where your institution prohibits such use is your responsibility.

Alfred may restrict or suspend use of the Platform where we reasonably believe it is being used for serious or repeated academic misconduct.

17. Acceptable use

You may use Alfred only for lawful purposes. You must not:

  • violate applicable law;
  • attempt to gain unauthorised access to Alfred;
  • compromise another user's Account;
  • interfere with or disrupt the Platform;
  • introduce malware or malicious code;
  • probe or attack Alfred's infrastructure without authorisation;
  • scrape or systematically extract Platform data without permission;
  • operate automated bots against Alfred without authorisation;
  • deliberately circumvent rate limits or usage restrictions;
  • abuse Guest mode or Free Trials;
  • create Accounts for fraudulent purposes;
  • impersonate others;
  • use Alfred to deceive, defraud, exploit, or intentionally harm another person;
  • unlawfully infringe intellectual-property rights;
  • resell access to an Alfred Account;
  • reverse engineer protected portions of Alfred except where applicable law expressly permits it;
  • bypass security or content restrictions; or
  • assist another person in doing any of these things.

We may investigate suspected violations.

18. Feedback

If you provide Alfred with suggestions, feature requests, ideas, bug reports, ratings, comments, or other feedback, you grant Alfred a worldwide, perpetual, irrevocable, royalty-free right to use that feedback to develop and improve Alfred without payment or attribution to you.

This does not transfer ownership of unrelated personal content contained in a feedback submission.

19. Alfred intellectual property

Alfred and its licensors retain all rights in the Platform and its proprietary technology.

This includes rights in the Alfred name, logos, mascot and brand assets, software, source code, interface designs, databases, systems, prompts, workflows, educational structures, proprietary documentation, and other Alfred materials.

Except for rights expressly granted under these Terms, no intellectual-property rights are transferred to you.

20. Third-party services

Alfred relies on third-party services to operate parts of the Platform. These may include providers of AI technology, cloud infrastructure, authentication, databases, storage, payment processing, communications, analytics, security, and related technology.

Third-party services may change over time.

Alfred is not responsible for independent third-party services that you choose to access outside the Platform.

Where Alfred directly integrates a third-party service to provide an Alfred feature, we remain responsible for our own obligations under applicable law but cannot guarantee uninterrupted operation of the third party's systems.

21. Service availability

We aim to provide a reliable service but do not guarantee uninterrupted availability.

Alfred may temporarily be unavailable because of maintenance, upgrades, security work, infrastructure failures, third-party outages, emergencies, or events beyond our reasonable control.

Features may also change as Alfred develops.

22. Beta and experimental features

Alfred may make experimental, preview, beta, or early-access features available.

Such features may change, contain errors, operate differently from final features, be discontinued, or have separate limitations.

We may restrict or remove experimental features without making them part of the permanent Platform.

23. Suspension and restrictions

Alfred may restrict, suspend, or terminate access where we reasonably believe that these Terms have been materially violated, the Account is being used fraudulently, Free Trial abuse has occurred, payment obligations have not been satisfied, the Platform is being misused, security is at risk, another user is at risk, unlawful activity has occurred, or restriction is reasonably necessary to protect Alfred.

Where appropriate, we may provide an opportunity to explain or correct the issue.

Immediate action may be taken where reasonably necessary for security, safety, fraud prevention, or legal compliance.

24. Appeals

Where Alfred restricts trial eligibility or Account access because of suspected abuse or fraud, you may request review of the decision.

We may consider relevant identity information, Account history, device signals, network information, usage history, previous trial activity, and security information.

We may ask you for additional information reasonably necessary to conduct the review.

An appeal does not guarantee reversal of a decision.

25. Closing your Account

You may close your Alfred Account through available Account settings or another method provided by Alfred.

Closing your Account ends your right to use Account-dependent Services.

Personal information associated with a closed Account will be handled according to the Alfred Privacy Policy.

Some limited information may continue to be retained where necessary for legal obligations, financial records, security, fraud prevention, trial-abuse prevention, dispute resolution, or enforcement of these Terms.

26. Disclaimers

To the maximum extent permitted by applicable law, Alfred is provided on an “as is” and “as available” basis.

We do not guarantee uninterrupted operation, error-free operation, complete accuracy of Generated Content, that every feature will always remain available, that Alfred will satisfy every educational requirement, or any particular academic result.

Nothing in these Terms excludes a warranty, guarantee, consumer right, or other protection that applicable law does not allow us to exclude.

27. Limitation of liability

To the maximum extent permitted by applicable law, Learn-Nova (Pty) Ltd and its directors, employees, contractors, and agents will not be liable for indirect, incidental, special, consequential, or punitive losses arising from the use of Alfred.

This may include loss resulting from reliance on inaccurate AI-generated information, academic consequences, service interruptions, third-party service failures, loss of data, unauthorised Account access caused by a user's failure to reasonably protect credentials, or misuse of the Platform.

Where liability cannot lawfully be excluded, our liability will be limited to the extent permitted by applicable law.

Nothing in these Terms excludes or limits liability where doing so would be prohibited by applicable law.

28. Indemnity

To the extent permitted by applicable law, you agree to be responsible for losses, claims, or costs reasonably arising from your unlawful use of Alfred, your material breach of these Terms, User Content you had no right to provide, infringement of another person's rights caused by your User Content, or deliberate misuse of Alfred.

This provision does not remove consumer rights or protections that cannot legally be excluded.

29. Privacy

Your use of Alfred is subject to our Privacy Policy.

The Privacy Policy explains, among other things, the personal information we collect, how we use User Content to improve Alfred, AI processing, device fingerprinting, anti-abuse processing, international data processing, account deletion, retention, and your privacy rights.

The current Privacy Policy is available at alfred-x.xyz/privacy.

30. Applicable law

These Terms are governed by the laws of the Republic of South Africa, subject to any mandatory rights or protections that apply to you under the laws of your country or region.

If applicable local consumer law gives you rights that cannot legally be waived or restricted by contract, those rights continue to apply.

Nothing in these Terms is intended to remove rights that applicable law does not permit you to waive.

31. Disputes

If you have a dispute with Alfred, we encourage you to contact us first so that the matter can be reviewed.

Where reasonably possible, the parties should attempt to resolve disputes through good-faith communication before beginning formal proceedings.

Subject to any mandatory rights you have under applicable law, disputes may be brought before the competent courts of South Africa.

Nothing in this clause prevents you from contacting a regulator, using a legally available consumer-dispute mechanism, exercising mandatory rights available in your country, or approaching another court or tribunal where applicable law gives you that right.

32. Changes to these Terms

We may update these Terms as Alfred develops or as legal, technical, or business requirements change.

The current version will be published at alfred-x.xyz/terms.

For material changes, we may provide notice through email, an in-app message, an Account notice, or another reasonable method.

Changes may take effect on the date identified in the updated Terms.

Where applicable law requires additional notice or consent, we will follow those requirements.

If you do not agree to updated Terms, you should discontinue use of Alfred and close your Account.

Continued use of Alfred after updated Terms become effective may constitute acceptance of those Terms to the extent permitted by applicable law.

33. General terms

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will continue to apply.

Our failure to enforce a provision does not permanently waive our right to enforce it later.

These Terms, together with the Privacy Policy and any additional terms presented for a specific service or purchase, form the agreement governing your use of Alfred.

Alfred may transfer its rights or obligations as part of a legitimate corporate reorganisation, merger, acquisition, financing, or sale, subject to applicable law.

You may not transfer your Account or contractual rights to another person without our permission where those rights are personal to you.
